This Privacy Policy explains how Captive Audience Marketing, Inc. (“we,” “us,” “our”) collects, uses, shares, and protects information when we send or receive business communications—including SMS, MMS, and RCS—through service providers (such as Twilio) for marketing and notifications across the United States.
2) Information We Collect
We may collect:

Contact details: phone number(s), name, organization, time zone, preferred language.

Message/call metadata: message content you send to us; delivery status; timestamps; routing information; carrier; device type; country; opt-in/opt-out events (e.g., STOP/HELP); short code/long code/sender ID; and applicable RCS identifiers.

Account & usage: interactions with our messages (including replies), support requests, consents and preferences, and related logs.

Transactional data: appointment reminders, order or account alerts, verification/authentication messages, and similar notifications.
3) How We Use Information

Marketing: send promotions, offers, product updates, surveys, and event notices (only if you’ve opted in).

Notifications: send transactional or informational messages (e.g., confirmations, service updates, reminders, security/auth codes).

Operations & support: troubleshoot delivery, monitor program performance, detect/prevent abuse, and improve our services.

Vendors/Processors: We use providers like Twilio to deliver communications. They process data under contracts requiring appropriate safeguards.

Carriers/Platforms: Mobile carriers and RCS platforms (e.g., Google RBM) receive limited data necessary to deliver messages.

Business transfers: Information may transfer in a merger, acquisition, or asset sale as permitted by law.

Legal: We may disclose information to comply with law, enforce our terms, or protect rights, property, or safety.
6) International Transfers
Our vendors may process data in countries outside your own (including the U.S.). Where required, we implement appropriate safeguards (e.g., standard contractual clauses).
7) Data Retention
We retain message logs and related metadata only as long as necessary for the purposes above—typically [up to 24 months] for marketing/program logs and [up to 4 years] for compliance/recordkeeping—unless a longer period is required by law or needed to resolve disputes.

9) California Privacy Rights (CPRA)
California residents may request access, deletion, correction, and information about our disclosure practices. We do not sell personal information and do not “share” personal information for cross-context behavioral advertising as defined by CPRA. 10) Security
We use reasonable administrative, technical, and physical safeguards (e.g., access controls and encryption in transit where supported). No system is 100% secure; please contact us promptly if you suspect unauthorized use.
11) Children’s Privacy
Our communications are not directed to children under 13. We do not knowingly collect such data. If you believe a child has provided us a phone number, contact support@captive-audience.com.
12) Changes to This Policy
We may update this Policy periodically. The “Last updated” date reflects the latest revision. Material changes will be posted on our website and/or communicated via message or email.
